The Lawfare Project Announces Support of Lawsuit Challenging Biden Administration's Unlawful Executive Order

The Lawfare Project announced today their financial backing of a lawsuit filed by Texans for Israel, a nonprofit organization, against the Biden Administration, along with other plaintiffs. The lawsuit challenges an unconstitutional Executive Order imposing sanctions on Israelis and their American supporters who dissent from the administration's policies regarding Judea and Samaria. Just weeks ago, following the presidential election, the administration announced new sanctions, including against leading Israeli development group Amana.

The lawsuit, filed in federal court in August, argues that the Executive Order violates fundamental constitutional rights, including free speech, due process, and equal protection under the law. Among its consequences, the Order has led to the freezing of bank accounts belonging to Jewish individuals who have peacefully protested the U.S.-backed provision of supplies to Gaza, much of which is intercepted by Hamas.

“It is unconscionable that an American President would target the only thriving, democratic ally in the region with the kind of sanctions reserved for terrorists and rogue states,” said Brooke Goldstein, Founder and Executive Director of The Lawfare Project. “This lawsuit is a critical step in defending constitutional rights and opposing the Biden administration's unlawful overreach, particularly as Israel faces existential threats. We are confident the federal judiciary will uphold justice and find in favor of the plaintiffs here."

“The Administration has weaponized the Executive Order to sanction peaceful protesters for trying to block aid to Hamas and a construction company for building homes in Jewish communities—while not sanctioning a single individual involved in the ongoing wave of Palestinian terror against Jews,” said Prof. Eugene Kontorovich of George Mason University Scalia Law School, a member of the legal team. “This also threatens Americans who, for religious reasons, support the Jewish presence in the Holy Land—they can be sanctioned simply for supporting peaceful organizations that the Biden Administration disfavors.”
