Hamas’s Violations of International Law
Today, The Lawfare Project published an overview of Hamas’s violations of international law, primarily during the recent war in Gaza.
The document focuses on Hamas’s violations of customary international humanitarian law (CIHL), Rule 156 of which provides that “[s]erious violations of international humanitarian law constitute war crimes.” As neither Israel nor the Palestinians are parties to the Rome Statute of the International Criminal Court (ICC), the UN Security Council should refer the situation to the ICC Prosecutor for investigation.
The Lawfare Project encourages widespread dissemination of the linked document, which may serve as talking points and to otherwise counter the disproportionate and inaccurate focus on Israel’s wartime conduct.
